As reported by Fox News Digital, Texas Democratic U.S. Senate candidate James Talarico is facing mounting criticism over his absence during a pivotal vote on legislation aimed at denying bail to illegal immigrants charged with violent felonies.

The proposed measure, known by Texas lawmakers as “Jocelyn’s Law,” was named in honor of 12-year-old Houston resident Jocelyn Nungaray, who prosecutors say was sexually assaulted and murdered in 2024 by two Venezuelan nationals who were illegally present in the United States. The bill sought to amend the Texas Constitution to automatically deny bail to illegal immigrants accused of violent felony offenses.

At the time of the vote in 2025, Talarico served in the Texas House of Representatives. While the legislation ultimately failed due to insufficient bipartisan support, critics argue Talarico’s absence during the final vote helped doom the measure at a time when Texans were demanding stronger protections from violent crime tied to the border crisis.

The controversy has resurfaced as Talarico campaigns for the U.S. Senate in a state heavily impacted by illegal immigration during the Biden administration. According to federal data compiled by the House Homeland Security Committee, the nation experienced more than 10.8 million border encounters and an estimated two million known “gotaways” during President Joe Biden’s tenure.

Republicans have sharply condemned Talarico’s record. Republican National Committee spokesperson Zach Kraft accused the Democrat of siding with violent offenders over Texas families grieving the consequences of failed border enforcement.

“It is disgusting that James Talarico is letting his anti-American agenda show by siding with a violent illegal over a Texas family,” Kraft told Fox News Digital.

The case surrounding Jocelyn Nungaray became a flashpoint in the national immigration debate after authorities alleged that Johan Jose Martinez-Rangel and Franklin Jose Peña Ramos abducted, assaulted, and strangled the young girl before abandoning her body in a creek drainage area near Houston. Federal authorities had previously encountered the two men near El Paso earlier that year before releasing them into the country under Biden-era parole policies.

Talarico’s campaign has rejected accusations that he is weak on crime. Campaign spokesman JT Ennis described the Democrat as a “law and order Democrat” who supports prosecuting violent offenders and increasing funding for police departments.

Still, critics point to a broader pattern in Talarico’s legislative record. During his time in the Texas House, he opposed the Damon Allen Act, legislation named after a slain Texas state trooper that restricted bail access for certain repeat offenders. He also voted against a constitutional amendment that would have denied bail to individuals accused of violent sexual offenses and trafficking crimes.

Talarico has additionally faced scrutiny over past immigration comments and activism. In 2019, he referred to illegal immigrants as “undocumented Americans” and stated they were “also my constituents.” He also appeared in messaging promoted by the activist organization United We Dream, which has advocated abolishing ICE and Customs and Border Protection. In the material, Talarico encouraged individuals not to open their doors to federal immigration agents and urged them to “fight back.”

For many Texas conservatives, the debate surrounding “Jocelyn’s Law” has become emblematic of a larger national struggle over border security, public safety, and government accountability.
